Terms of Service

These Terms of Service ("Terms") govern your use of the Rescue Your Leads platform and services ("Service") operated by Rescue Your Leads ("we," "us," or "our"). By signing up for or using our Service, you agree to these Terms.

1. Service Description

Rescue Your Leads provides automated lead recovery and customer engagement tools for small service businesses, including:

  • Missed call detection and automated SMS follow-up
  • Estimate follow-up automation
  • Automated Google review generation
  • Lead reactivation campaigns
  • Appointment reminder and no-show reduction
  • A client dashboard for managing leads and viewing activity

2. Account Registration

  • You must provide accurate and complete information during registration.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must be at least 18 years old and authorized to bind your business to these Terms.
  • One account per business. You may not resell or sublicense access to the Service without our written consent.

3. Fees & Payment

  • Monthly Subscription: $149 per month, billed on the same day each month. Your subscription automatically renews each billing cycle until cancelled.
  • Auto-Renewal: Your subscription will automatically renew and your payment method will be charged at the start of each billing period. You may cancel auto-renewal at any time before the next billing date.
  • Add-On Services: Lead reactivation campaigns and other add-ons are priced separately and disclosed before purchase.
  • Payment Method: All payments are processed via Stripe, Inc., a PCI-compliant payment processor. You authorize us to charge your payment method on file for all applicable fees. Your payment details are stored securely by Stripe and are never stored on our servers.
  • Failed Payments: If a payment fails, we will attempt to charge your payment method up to 3 times over 10 days. If payment remains unsuccessful, your account may be suspended.
  • No Refunds: Monthly subscription fees are non-refundable for the current billing period but you will not be charged for subsequent months after cancellation.

4. Cancellation

  • You may cancel your subscription at any time by contacting us at hello@rescueyourleads.com.
  • Cancellation takes effect at the end of your current billing period. You retain access until then.
  • There are no long-term contracts, cancellation fees, or early termination penalties.
  • Upon cancellation, your data is retained for 90 days, then permanently deleted. You may request data export before deletion.

5. Your Responsibilities

By using our Service, you agree to:

  • TCPA Compliance: You are solely responsible for obtaining prior express consent from your customers before any automated text messages are sent on your behalf. You represent and warrant that all contacts in your account and uploaded lists have consented to receive text messages from your business.
  • Accurate Information: You will provide accurate business information, phone numbers, and customer data.
  • Lawful Use: You will not use the Service for any illegal, deceptive, or harmful purpose, including spam, harassment, or sending messages to individuals who have not consented.
  • Opt-Out Compliance: You will honor all customer opt-out requests. Our system automatically processes STOP requests, and you agree not to circumvent this functionality.
  • Customer List Ownership: You represent that you have the legal right to contact all individuals on any customer lists you upload for reactivation campaigns.

6. SMS Messaging Terms

  • Automated messages are sent via third-party providers (e.g., Twilio) on behalf of your business.
  • All automated messages include opt-out instructions ("Reply STOP to opt out").
  • Message frequency varies based on your configured automation flows.
  • Standard messaging rates apply to message recipients.
  • We reserve the right to suspend messaging for any account found in violation of TCPA, carrier policies, or these Terms.

7. Intellectual Property

  • The Rescue Your Leads platform, website, brand, and all associated intellectual property are owned by us.
  • You retain ownership of your business data, customer data, and content you provide.
  • You grant us a limited license to use your data solely to provide the Service.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • The Service is provided "as is" without warranties of any kind, express or implied.
  • We do not guarantee specific results, including the number of leads recovered, revenue generated, or reviews obtained.
  • We are not liable for any SMS delivery failures caused by carrier issues, phone number errors, or recipient actions.
  • Our total liability for any claim arising from or related to the Service shall not exceed the fees you have paid to us in the 3 months preceding the claim.
  • We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits or lost business opportunities.

9. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including attorney's fees) arising from:

  • Your violation of these Terms.
  • Your failure to obtain proper consent for automated messaging.
  • Any claims brought by your customers related to messages sent through our Service.
  • Your violation of any applicable law or regulation.

10. Service Availability

  • We strive for high availability but do not guarantee uninterrupted service.
  • We may perform scheduled maintenance with reasonable advance notice.
  • We reserve the right to modify, suspend, or discontinue any feature of the Service with 30 days' notice.

11. Termination

We may suspend or terminate your account if:

  • You violate these Terms.
  • Your account is used for illegal activity or spam.
  • Your payment remains delinquent after our retry attempts.
  • Your messaging practices result in carrier complaints or blocks.

We will provide notice before termination when reasonably possible.

12. Governing Law

These Terms are governed by the laws of the State of Michigan. Any disputes will be resolved in the state or federal courts located in Michigan.

13. Changes to These Terms

We may update these Terms from time to time. We will notify active clients of material changes via email at least 14 days before they take effect. Continued use after changes constitutes acceptance.
